NGO sues Kogi Government over cashew purchase restriction

A Lagos-based non-governmental organisation, Initiative for the Downtrodden, has taken a bold step to challenge a policy by the Kogi State Government that restricts buyers from directly purchasing cashew from farmers. The policy, introduced in 2022 and strengthened in November 2025, mandates buyers to purchase cashew through designated agents, allegedly leading to exploitation and financial losses for local farmers.

Edibo KenPeacemaker Onojah, National President of the NGO, argues that the policy is unconstitutional, as it restricts free trade and undermines farmers’ economic rights. “The policy is a clear violation of the people’s rights, an example of government overreach and an attempt to stifle competition,” Edibo said.

The lawsuit, marked FHC/L/CS/119/26, seeks to have the policy declared null and void and to restrain the Kogi State Government from enforcing it. The case is expected to be heard soon, subject to court convenience.

The action is being viewed as public interest litigation aimed at defending the rights of Kogi State’s cashew farmers to own property and freely dispose of their wealth. The outcome of the case could have significant implications for the cashew industry in Kogi State and beyond.
